WHEREAS, the Department of Institutions was changed into the Department of Corrections and Human Services, which was then separated into the Department of Public Health and Human Services and the Department of Corrections; and
WHEREAS, the Department of Public Health and Human Services has administrative responsibility to manage the land comprising the former Montana Development Center Campus in Jefferson County; and
WHEREAS, the Department of Corrections has occupied portions of the former Montana Development Center Campus for use as the Riverside Youth Correctional Facility; and
WHEREAS, the Department of Public Health and Human Services has determined that it no longer needs or wishes to use certain lands identified in the attached Agreement for Transfer of Administrative Responsibility for Management of Land; and
WHEREAS, the Department of Corrections has identified that it will use lands currently under the management of the Department of Public Health and Human Services; and
WHEREAS, the Department of Public Health and Human Services and Department of Corrections have prepared a detailed agreement governing the transfer of administrative responsibility; and
WHEREAS, the reorganization of the former Department of Institutions requires the Governor to resolve any conflict as to the proper disposition of property pursuant to Montana Code Annotated §2-15-132.
NOW, THEREFORE, I, MARC RACICOT, Governor of the State of Montana, pursuant to the authority vested in me as Governor under the Constitution and laws of the State of Montana, Title 2, Chapter 15, MCA, and other applicable statutes do hereby declare and approve the transfer of and management of the lands identified in the attached Agreement for Transfer of Administrative Responsibility for Management of Land from the Department of Public Health and Human Services to the Department of Corrections.
This order is effective immediately.
