Executive OrderExecutive Order Authorizing Incident Response Authority In The State Of MontanaWHEREAS, Civil Disobedience Rallies were scheduled for the weekend of April 15, 2000, in the City of Libby and Lincoln County; and WHEREAS, such rallies caused great concern with Local Government and Law Enforcement Agencies; and WHEREAS, the City of Libby and Lincoln County committed available resources and took all necessary actions to respond to the situation; and WHEREAS, the City of Libby and Lincoln County each declared a state of emergency; and WHEREAS, the City of Libby and Lincoln County requested and subsequently received state assistance through the Disaster and Emergency Services Division to assist with this incident; and WHEREAS, the availability and utilization of all necessary state government services, equipment and supplies under this proclamation augmented local efforts to protect health and safety and to preserve the lives, property and resources of the people of the State of Montana; and WHEREAS, a proclamation of an "incident", as that term is defined in Section 10-3-103(7), MCA, requires action by disaster and emergency services personnel, and Section 10-3-310(2)(c), MCA, authorizes the Governor to expend funds from the general fund to prevent or minimize loss of life or damage to property or natural resources. NOW, THEREFORE, I, MARC RACICOT, Governor of the State of Montana, pursuant to the authority vested in me as Governor under the Constitution of the State of Montana, Title 10, Chapter 3, MCA, and under other applicable statutes do hereby declare that an "incident" existed within Lincoln County. This Order is effective April 9, 2000.
