Executive OrderExecutive Order Authorizing Incident Response Authority In The State Of MontanaWHEREAS, on March 16, 2000, an explosion occurred in Richland County, in the Town of Fairview, causing personal injury to several residents and extensive damage to businesses, residences and structures; and WHEREAS, the explosion was felt and did cause damage to the Town of East Fairview in the State of North Dakota; and WHEREAS, of the residences affected, 9 were destroyed, 4 suffered major damage and 7 suffered minor damage; and WHEREAS, many of the damaged and destroyed residences were not insured; and WHEREAS, Richland County and the Town of Fairview requested Disaster and Emergency Services Division to assist with this incident; and WHEREAS, the availability and utilization of all necessary state government services, equipment and supplies under this proclamation will further the efforts to protect health and safety and to preserve the lives, property and resources of the people of the State of Montana; and WHEREAS, a proclamation of an incident, as that term is defined in section 10-3-103(7), MCA, signifies the occurrence of an event that requires action by disaster and emergency services personnel, and section 10-3-310, MCA, authorizes the Governor to expend funds from the general fund to prevent or minimize loss of life or damage to property or natural resources. NOW, THEREFORE, I, MARC RACICOT, Governor of the State of Montana, pursuant to the authority vested in me as Governor under the Constitution of the State of Montana, Title 10, Chapter 3, MCA, and under other applicable statutes do hereby declare that an incident exists in the state of Montana due to an explosion in Richland County and the Town of Fairview. This Order is effective March 16, 2000.
