Executive Order 28-00



EXECUTIVE ORDER TRANSFERRING ADMINISTRATIVE RESPONSIBILITY FOR MANAGEMENT OF THE DR. XANTHOPOULOS FORENSIC UNIT AT THE MONTANA STATE HOSPITAL FROM THE DEPARTMENT OF PUBLIC HEALTH AND HUMAN SERVICES TO THE DEPARTMENT OF CORRECTIONS

WHEREAS, the Legislature passed Mont. Code Ann. §53-1-202 (1995) which requires the Governor, by Executive Order, to declare that the construction of a new forensic unit at the Montana state hospital complex in Warm Springs, Montana, is complete; and

WHEREAS, the Department of Public Health and Human Services has certified that the construction of the new forensic unit at the Montana state hospital complex is complete; and

WHEREAS, the Department of Administration, Architecture & Engineering Division, has certified that the construction of the new forensic unit at the Montana state hospital complex is complete; and

WHEREAS, the Department of Public Health and Human Services and the Department of Corrections have agreed that the transfer of the Dr. Xanthopoulos forensic unit should occur; and

WHEREAS, the Department of Corrections has identified that it will use the Dr. Xanthopoulos forensic unit currently under the management of the Department of Public Health and Human Services as a fourth regional prison; and

WHEREAS, the Department of Public Health and Human Services and Department of Corrections have prepared a detailed agreement governing the transfer of administrative responsibility.

NOW, THEREFORE, I, MARC RACICOT, Governor of the State of Montana, pursuant to the authority vested in me as Governor under the Constitution of the State of Montana, Title 2, Chapter 15, and Title 53, Chapter 1, Part 202, MCA, and other applicable statutes, do hereby declare and approve the transfer of and management of the Dr. Xanthopoulos Forensic Unit of the Montana State Hospital from the Department of Public Health and Human Services to the Department of Corrections.

This Order is effective immediately.
