Executive Order

EXECUTIVE ORDER PROCLAIMING AN EMERGENCY TO EXIST IN CUSTER COUNTY

WHEREAS, a series of severe thunderstorms occurred across portions of Custer County between June 29 and July 1, 2001 and produced very heavy amounts of rainfall in short periods of time; and

WHEREAS, extensive damage occurred to roadways, bridges and culverts because of the heavy water run-off; and

WHEREAS, on July 3, 2001, anticipating that problems resulting from these damages might exceed the county's ordinary capability to manage, the Custer County Commissioners declared a disaster, and implemented provisions of their County Emergency Operations Plan; and

WHEREAS, the anticipated cost of repairing the roads and bridge will exceed the county's financial capability, and on July 9, 2001, the Custer County Commissioners passed a resolution implemented a two (2) mill emergency levy for fiscal year 2002; and

WHEREAS, on July 10, 2001, the Custer County Commissioners sent the Governor a letter requesting supplemental disaster relief from the state; and

WHEREAS, the availability and utilization of all necessary state government services, equipment and supplies under this proclamation will further the efforts to protect health and safety and to preserve the lives, property and resources of the people of the State of Montana; and

WHEREAS, a proclamation of an emergency authorizes the Governor under Section 10-3-104(2)(a), MCA, to suspend Section 2-18-501, MCA, to allow reasonable expenditures for food and lodging for State Disaster and Emergency Services Division personnel responding to this emergency; and

WHEREAS, a proclamation of an emergency authorizes the Governor under Section 10-3-311, MCA, to expend funds from the general fund to meet contingencies and needs arising from these conditions.

NOW, THEREFORE, I, JUDY MARTZ, Governor of the State of Montana, pursuant to the authority vested in me as Governor under the Constitution of the State of Montana, Title 10, Chapter 3, MCA, and under other applicable statutes, do hereby declare that an emergency exists in Custer County of the State of Montana.

This Order is effective July 1, 2001.
