Executive Order 11-03

EXECUTIVE ORDER CONTINUING THE RISK MANAGEMENT ADVISORY COUNCIL

WHEREAS, the Department of Administration, pursuant to Section 2-9-101, MCA, is charged with the acquisition and administration of all insurance purchased for the protection of the State of Montana;  and

WHEREAS, the Department of Administration, pursuant to Section 2-9-303, MCA, shall investigate, evaluate, and resolve property/casualty claims on behalf of State of Montana agencies; and 

WHEREAS, State of Montana agencies, pursuant to Section 39-71-1501, MCA through 39-71-1508, MCA, shall establish comprehensive and effective loss prevention programs in order to protect state government's vital physical, financial, and human resources.

NOW, THEREFORE, I, JUDY MARTZ, Governor of the State of Montana, by virtue of the authority vested in me pursuant to the Montana Constitution and the laws of the State of Montana, do hereby create the Governor's Risk Management Advisory Council (the "Council"), in accordance with the provisions of Section 2-15-122, MCA, for the purposes set forth below.

I.          PURPOSE: The purpose of the Council shall be as follows:

1.         Serve in an advisory capacity to identify issues, costs savings, or efficiencies in the procurement and administration of the state property/casualty insurance plan and advise on the structure of the state's insurance coverage.

2.  Serve in an advisory capacity to evaluate processes used by the state to adjust claims, identify cost savings, and/or improve the efficiency of the division's claims administration processes.

3. Serve in an advisory capacity to assist the Department of Administration to mitigate risk.

II.          COMPOSITION:

The Council shall consist of no more than eight (8) members and must include: representatives of the insurance industry, claims adjusters, self-insured organizations, regulatory bodies, private firms, public entities, legislators, or any other applicable organization.

The Director of the Department of Administration or his/her designee shall serve as the presiding officer. The full committee shall convene at least annually.  Subcommittees consisting of uniform or similar risk management issues shall convene from time to time as requested by the presiding officer. 

III.         DURATION:

This Advisory Council shall exist for two years from the effective date of this order, unless terminated earlier  by subsequent Executive Order.

This Order is effective immediately.
